Reclassification of Major Sources to Area Sources under NESHAPs

On July 26, the USEPA proposed amendments to the General Provisions of the NESHAPs providing that a major source can reclassify to area source status at any time by limiting PTE to below HAP major source levels.  This would allow sources to escape the “Once in Always in” policy and avoid continuing to be subject to Major Source MACT requirements.  Comments on the proposed changes are due by September 24, 2019.  Please see the Federal Register’s July 26, 2019 publication: https://www.govinfo.gov/content/pkg/FR-2019-07-26/pdf/2019-14252.pdf.
